Paul vs. Michael Moore on ‘Larry King Live’ Posted by David Kramer on October 29, 2009 09:50 PM Lew Rockwell Blog Notice that Larry makes the same mistake that most non-Libertarians (including myself when I was a far-Left Liberal) make: He thinks of the government as some monolithic entity rather than it being made up of human beings. He doesn’t understand that if he and millions of others are concerned about the less fortunate, it would be much more efficient for himself and those others to start their own voluntary charitable services rather than leaving it up to the inefficient forced monopoly of government to perform those services. He also believes the lie (which I did too) that there’s a difference when a group of people calling themselves ‘the government’ forcibly takes money from you (through taxation) than when an individual (i.e., a robber) forcibly takes money from you. Trying to justify this difference with, “But the government is doing it for a good purpose, unlike a robber” doesn’t work. It’s not up to some other person(s) to decide what is “a good purpose”—and then force you to give your own money to it. It’s your decision to determine what is a “good purpose” for which you want to donate your money. Of course, as I always like to concede, if you feel you want the government to take care of your charitable giving—fine, but I don’t want the government to take care of my charitable giving. Please grant me the same concession.

Buddy' GPS device keeps tabs on your kid October 27, 2009 Sandra Guy, Chicago Sun-Times Best Buy is selling a transmitting device that lets parents keep track of their children. Parents can place the device in a child's backpack or lunch box, for example. The "Little Buddy Child Tracker" retails for $100 (far less than other devices that sell for $200 to $500). It combines global satellite positioning and cellular technology to signal the child's whereabouts to a computer or smartphone. Parents can program the device to set up specific times and locations where the child is supposed to be -- in school or at home, for example -- and the device sends a text message if the child leaves the site in that time. The device immediately drew angry writeups from some techies, who called it a reason for children to run away from home. So if you get these for your kids, does CPS smash it when they kidnap the kids? |

Gain Associated With Antipsychotic Drugs By DUFF WILSON Published: October 27, 2009 New York Times Young children and adolescents who take the newest generation of antipsychotic medications risk rapid weight gain and metabolic changes that could lead to diabetes, hypertension and other illnesses, according the biggest study yet of first-time users of the drugs. The study, to be published Wednesday in The Journal of the American Medical Association, found that 257 young children and adolescents in New York City and on Long Island added 8 to 15 percent to their weight after taking the pills for less than 12 weeks. The patients, ages 4 to 19, added an average of one to one-and-a-half pounds a week. “The degree of weight gain is alarming,” said Dr. Wayne K. Goodman, head of a Food and Drug Administration advisory panel on the drugs last summer and chairman of psychiatry at Mount Sinai School of Medicine in Manhattan. “The magnitude is stunning,” he said. Although the drugs’ influence on weight and metabolism had been previously detected, Dr. Goodman, who was not involved in the study, said the speed and magnitude of the effects found in the study were greater than previously reported — findings he said were made possible by looking exclusively at new patients. The four drugs in the study, the most popular antipsychotic medications, are industry blockbusters, with combined sales of $12.7 billion last year. And while all four caused weight gain, there were differences in the extent of the side effects. Among them, Zyprexa, made by Eli Lilly & Company, showed the most severe effects on weight and metabolism. The study’s authors, and an accompanying JAMA editorial, called for closer monitoring of patients taking the drugs, as well as additional long-term studies. The drugs are prescribed for schizophrenia, bipolar disorder and a broad range of less serious psychological conditions. A 2008 study found that patients under 19 years old accounted for 15 percent of antipsychotic drug use in 2005, compared with 7 percent in 1996. State Sen. Royce West will attend the ceremony. A press release from CPS says the new office at 1111 Ledbetter Dr., "is opening as part of a concerted effort to address the needs of the community in the 75216 ZIP Code." According to CPS: Research has shown that issues of poverty, teen pregnancy and crime contribute to higher numbers of Child Protective Services investigations in this area of South Dallas. Residents in the 75216 ZIP Code die younger than in other areas of Dallas. In 2005, only 48% of residents aged 25 and older finished High School compared to 70% for the rest of the city of Dallas. Also, the crime rates were higher in this area of South Dallas than in other areas. Residential personal crime was five times the city rate. The office will house 28 CPS staffers. Nineteen boys and 33 girls were bought from impoverished rural families in Shanxi and Hebei provinces in the past two years, Xinhua news agency said. The 42 suspects earned about $60,000 overall from the alleged trafficking, Xinhua said Friday. The ring started crumbling after three men were arrested with a baby boy in their van, Xinhua said. The three said they had bought the baby from a woman and her daughter in Hebei, according to Xinhua. The women had sold 12 other babies to the men, and were arrested, Xinhua said. China has a one-child policy, forcing some parents to sell female babies in order to try for a boy, who are preferred traditionally. Commander Andrew William Young had the largest amount of child porn internet investigators within the department have ever seen.
But now, instead of helping children, investigators fear he might have done the worst. ...Police broke the news by computer, accusing 46-year-old Young of using his computer to commit crimes against children. They say his hard drive contained hundreds of thousands of images of child sexual abuse. "It can be considered like a stepping stone to actually physically harming a child," said Detective Tammy Dunn, "Because of that reason we were extremely concerned when discovering Mr. Young is associated with children. His entire career as a therapist is around children and only children." Young worked with children both here in Alaska, and across the globe as a child therapist. "Texas, Florida, Virginia, Maine, New Hampshire, Massachusetts, New York, Wisconsin, Connecticut, Germany and Iraq," said Det. Mark Thomas, listing the locations of Young's patients. By William Ecenbarger For The Philadelphia Inquirer WILKES-BARRE - In October 2005, a 16-year-old boy appeared in Luzerne County Court to answer charges that he had shot out several windows in a city home with a BB gun. The boy had never been in trouble with police before, and even the homeowner asked the judge to be lenient, according to a federal lawsuit. Nevertheless, Judge Mark A. Ciavarella, after repeatedly silencing the boy's court-appointed attorney, ignored the homeowner's request and in a matter of minutes banged his gavel and said, "Adjudicated delinquent!" The boy was handcuffed, shackled, and taken in a van about 50 miles to a juvenile "boot camp" for the next three months, the complaint states. The boy's brief hearing in dark-paneled Courtroom 4 was closed to the public, but it was witnessed by an assistant district attorney, the public defender, other lawyers, probation officials, bailiffs, clerks, and other court staff, according to the suit, filed by the Juvenile Law Center of Philadelphia. Now the monumental task facing a special 11-member commission investigating what one advocacy group called "one of the largest and most serious violations of children's rights in the history of the American legal system" (no, pretty much common-place) is to determine how something like that could happen, how it can be prevented - and why no one spoke up. faults state for failing to detect abuse of foster child By David Steves The Register-Guard Posted to Web: Friday, Oct 23, 2009 12:04AM Appeared in print: Friday, Oct 23, 2009, page B2 Oregon- Foster parents from Cottage Grove, a Springfield-based state caseworker and the state Department of Human Services are being sued for $1.6 million after a foster child suffered injuries from a beating so severe that he required hospitalization, according to court papers filed this week. The lawsuit was filed in Multnomah County on Tuesday by lawyers representing the 4-year-old boy, who is identified in the complaint as “B.C.” The suit contends that in November 2008, while in the care of foster parents Keith and Nelly Burr, the boy, then 3, suffered a severe brain injury that involved internal bleeding, as well as a lacerated spleen. By the time he arrived at a hospital emergency room, the child’s body temperature was dangerously below normal, according to the lawsuit. Medical personnel there reported bruises in various stages of healing on his knees, thighs, buttocks, back, ankle, forehead and penis, the court papers said. The lawsuit also alleges that state Department of Human Services child welfare caseworker Joann Turner failed to document previous injuries or to investigate their cause. ‘Caged Teens’ Sue Adoptive Parents Associated Press Published: October 22, 2009 CLEVELAND—Two Ohio teenagers forced to sleep in cages have sued their adoptive parents and caseworkers who arranged the adoptions. The lawsuit was filed Tuesday in Cuyahoga County Common Pleas Court in Cleveland on behalf of 18-year-old Sharen and 17-year-old Michael Gravelle. They were named for their adoptive parents, who are now serving two-year prison terms for abusing some of their 11 adopted special-needs children. The suit also targets caseworkers and the Hamilton County Department of Job and Family Services in Cincinnati. The suit says the Gravelles were unfit to be parents and should never have gotten custody of the children. The prosecutor’s office which handles legal matters for the county agency had no immediate comment Thursday. Some day, a bunch of the kidnapped kids are going to sue CPS. | Police: Foster Children Plotted to Kill Foster Parents Posted: Oct 19, 2009 7:15 PM PDT Updated: Oct 19, 2009 8:34 PM PDT By Kirsten McIntyre, NEWS 9 WOODWARD, Oklahoma -- Two foster parents were attacked by their foster children, and the father said he’s lucky to be alive. Investigators say the girls, 16-year-old Ashley Jewel and 15-year-old Kelsey Beams, plotted to kill their foster parents. Robert and Barbara Parker have been foster parents for DHS for four years. The two teens are among the many children they’ve taken into their care. Ashley has been the Parker’s foster child for two years while Kelsey was in their care for two months. Robert Parker is a pastor. His family was in the process of resigning from his church in Henrietta and moving back to Woodward. He planned to start a street ministry in the area. The Parkers had come to Woodward to work on house that they own. While staying the night, Robert woke up around 1 a.m. saying he heard a bang and saw a flash. It took a few seconds before Robert and Barbara Parker realized he’d been shot. Police say the two girls wanted to kill the couple because they wanted to be free from DHS custody. Police think Kelsey was mastermind and manipulated Ashley into shooting Robert Parker. According to the police report, Ashley fired a shot at Robert Parker. The gun jammed when she tried to shoot her foster mother Barbara. Police said Kelsey had a second gun, but it had the wrong bullets in it so it never would have worked. The bullet hit Robert in the rib. It’s still lodged in his chest and doctor’s say it shouldn’t cause any issues. Because of the circumstances surrounding the incident and where the bullet hit, Robert and Barbara Parker believe it’s a miracle he’s alive. The girls will be charged as youthful offenders, among their charges is shooting with intent to kill. Ashley had run away from another foster home 2 years ago and was upset because her brother is being sent to mental institution. |

I have participated in dozens of court hearings on behalf of parents subject to "child protection" proceedings. I am always struck by the zeal with which the lawyers for our local Children's Aid Society and Catholic Children's Aid Society fight for what they perceive are the child's "best interests." Compromise is difficult and inflexibility is the norm. The cases drag on in even the simplest matters. Many colleagues have expressed frustration at how aggressive the local societies have become in prosecuting these cases. There is huge cost to the families (including the children), financially and emotionally. Their funding issues could be easily met, in my view, if the societies redirected their efforts from prosecution and toward providing real, concrete assistance. Too often, society social workers spend their time drafting affidavits, sitting in court and preparing for litigation instead of in the field, helping families and children in crisis. Litigating is the most expensive option. It is too often chosen by the societies as the first resort. When I started practising in Hamilton in 1988, there was one lawyer handling all the child protection cases for both societies. Occasionally, a local lawyer was hired to take a trial. Now, there are close to 20 lawyers working for both societies. This shows the emphasis of the societies has been on litigation, not remediation. These lawyers are very good and very expensive. I suggest that instead of trying to scare the public and policy-makers with threats of "having difficulty responding to high-risk child abuse allegations (unless we get more money)," they should try to manage their budgets more effectively. Fewer lawyers and more empathetic and caring social workers are the answer. This lawyer hit the nail on the head. As the colloquialism goes: "There's your problem". This is the mode of operation of CPS in every westernized country in the world. |

federal grant to improve child welfare by Erin Snelgrove Yakima Herald-Republic POSTED ON Thursday, October 15, 2009 AT 10:32PM YAKIMA, Wash. -- Catholic Charities of the Diocese of Yakima and Catholic Family & Child Service of the Tri Cities are receiving a $900,000 federal grant to change the child welfare system in Central and Eastern Washington. The grant was bestowed by the U.S. Department of Health and Human Services' Administration for Children and Families. It is renewable for three years -- assuming benchmark goals are achieved. An additional $225,000 was pledged for each of the three years by other funding partners. This was the only grant bestowed to Washington state, and it's expected to serve 840 youths. "This is all about foster kids," said John Young, executive director of Catholic Charities of the Diocese of Yakima. "Twenty-four of us in the country got this grant. We feel pretty good about that." The funding benefits a wide swath of the region, including Yakima, Kittitas, Franklin and Benton counties. Catholic Charities will work with CFCS, Casey Family Programs and the Yakama Nation to establish the Family Connections Demonstration Project. The project calls for helping kinship and tribal caregivers navigate complex governmental and regulatory systems. Aggressive efforts will be made to locate and place children with blood relatives, and decisions regarding children will be made by bringing together care givers and other institutional players.
The overarching mission is to reduce the number of children in state
custody, as well as to shorten their length of stay in the system, said
Maureen McGrath, agency director of CFCS in the Tri Cities.She hopes the data will serve as a blueprint to be replicated in other areas of the state and the nation. "The goals of the project really mirror the goals of Adoption and Safe Families Act, which is safety, permanency and well being for children," McGrath said. "This will breathe new life into the system."

FILED TO HALT SWINE FLU VACCINE DISTRIBUTION WASHINGTON – With the U.S. Food and Drug Administration scheduled to begin nationwide delivery this week of swine flu vaccine to 90,000 government-approved locations, attorney James Turner filed a complaint Friday in federal court in the District of Columbia for a Temporary Restraining Order to halt the distribution, licensing and use of four controversial vaccines -- including their use under an existing Emergency Use Authorization (EUA) -- until there has been adequate safety testing and a full opportunity for public hearings. The suit challenges the Sept. 15 licensing of four swine flu vaccines, alleging that the FDA violated the law in its hurried approval by failing to determine the safety and efficacy of the vaccines as required by law since 1964. For ten years, two women lived together in a lesbian relationship, during which one of them -- Barbara Maniaci -- solely adopted two children. But in 2006, Maniaci left her roommate and the homosexual lifestyle, and later married a man. Following the break-up, the former roommate sued for -- and now has won -- parental rights. Austin Nimocks, senior legal counsel with the Alliance Defense Fund, tells OneNewsNow that Montana's highest court decided to uphold the demands of a legal stranger. "What the Montana Supreme Court did was give a third party -- the parent's former roommate and girlfriend -- parental rights...," says the attorney. "And it runs contrary to clear precedent dating back several years in Montana and the United States Supreme Court. [It's] a very, very disturbing decision." He says that historically courts have upheld the rights of "fit natural" parents. "When we undermine the rights of fit natural parents, it causes harm to families and children," argues Nimocks. "Giving strangers and third parties access to kids is not in the best interest of children or families." In making the decision, Nimocks contends the court undermines the rights of parents to control the upbringing of their children and to make sure that their authority is the final authority. One of the dissenting judges in Montana wrote that the decision in favor of a third party "will open a Pandora's Box of potential attacks upon the right of fit and capable parents to raise their own children." (AP) -- The estate of a 2-year-old girl who died while in foster care in El Paso County is suing the county. Alize (Al-uh-ZAY') Vick died last week, a day after suffering what a neurosurgeon described as a "violent blow to the head." Her foster mother, Jules Lynn Cuneo, was later arrested on suspicion of first-degree murder and felony child abuse. In a lawsuit filed in federal court, the estate's representative, Mark Elliott alleges that social workers ignored warning signs about possible abuse in the foster home. The county's Department of Human Services declined comment on the lawsuit.

Arlington County recently received $187,600 in state tobacco settlement money to fund its "Strengthening Families Program." How much of it will be used to identify at-risk families so that Arlington judges and social workers can tear them apart? Think that's too harsh? Talk to Nancy Hey (an AFRA member) or Benita Washington, whose parental rights were both terminated on unsubstantiated grounds of medical neglect by Arlington Juvenile Court Judge Esther Wiggins Lyles and Circuit Judge James Almand. Hey's daughter, Sabrina -- snatched by Arlington social workers when she was just 3 weeks old -- was later adopted by her politically connected foster parents. Washington's 8-year-old son, Moses, also lingered in foster care for three years. Federal law requires social service agencies to document reasonable efforts to place foster children with next of kin. Adoption is supposed to be a last resort. When I asked Kurt Larrick of Arlington's Child Protective Services why family members had not been given a chance to adopt Moses, now 11, he refused to discuss the case except to say: "We have done everything by the book." Abuse Investigator Plan Struggles POSTED: Monday, October 12, 2009 UPDATED: 6:32 pm CDT October 12, 2009 Click2houston.com HOUSTON -- Texas' plan to hire hundreds of child abuse investigators with law enforcement backgrounds was designed to save children and improve investigative techniques throughout the ranks of Child Protection Services caseworkers. But four years later, hundreds of the "special investigators" have left the agency amid complaints of culture clash and ineffectiveness, and one-third of the positions are vacant, the Houston Chronicle reported in Monday editions. The newspaper's review of state records shows that 273 of the 431 investigators hired in the past four years have left. CPS has been under scrutiny over the investigations into four recent child deaths -- none of which was handled by a special investigator. Three Houston-area children have died from abuse after they had been reported to CPS as possible abuse victims. And last month a 1-year-old Arlington boy died in a hot car; CPS had contacted his family several times and his mother has a history of abuse and neglect. CPS spokesman Patrick Crimmins said the agency knew there would be challenges assimilating law enforcement types into the agency and acknowledged some friction, but he also said the special investigators are making the agency stronger. Investigators who have left said the job description was muddled and that there was a major culture clash between the seasoned former law enforcement officers and the often younger and less experienced CPS caseworkers. Foster parents feel punished for speaking out 10:42 PM PDT on Monday, October 12, 2009 By SUSANNAH FRAME / KING 5 News SEATTLE - Nearly 6,000 families in our state have stepped up to the plate to be foster parents, caregivers to abused or neglected children that have been taken away from their parents by the state or law enforcement. Since the KING 5 Investigators started exposing flaws in the foster care system through the story of a child nicknamed "Poca," dozens of foster parents have contacted KING 5 to say it's risky business, that the state will use its power to turn on foster parents who challenge the system. Thirty foster parents who feel this way gathered in the KING 5 studios recently for a group interview to tell their stories. Each one had one thing in common: They aggressively advocated for a foster child in their care and feel they paid a price for it. One woman said her state payments for her foster child were reduced after she spoke out. Another couple said state workers called in bogus licensing violations about them after they challenged decisions made by state social workers.

the process by not being notified of court dates involving their foster

For years, when asked which governmental program I would most like to see disappear, my answer has been a consistent one: the government school systems. The latest example of the institutionalized child abuse that is synonymous with government schools is that of the 6 year old boy who has been suspended from school, and now faces a 45 day sentence in reform school, for bringing his Cub Scout knife/fork/spoon camping tool to class. School officials defended this action as an expression of a “zero tolerance” policy regarding anything that could be used as a “weapon.” “Zero tolerance” is but a euphemism for “inability to discriminate.” It being a central purpose of government schools to discourage the development of the capacity for making clear distinctions among competing ideas and values, one must quash any tendency for people to act upon selective judgments whenever the practice raises its ugly head. It used to be the highest compliment to tell another that he or she had a “discriminating” mind; it is now an accusation. If a Cub Scout eating utensil in the hands of a 6 year old is to be distinguished from a machete wielded by a distraught teenager, people – beginning with small children – will get in the habit of using their minds to make independent judgments as to other matters. The Cub Scout must take his punishment, alongside the child who offered a friend a cough-drop (contrary to a “zero tolerance” drug policy), as well as the kindergartner who kissed a classmate on the cheek and faced sexual harassment charges! “Zero tolerance” policies war against the mind and clear thinking. If children are allowed to grow up with rational, discriminating minds, where will future school administrators be found? Worse yet, how could a political system sustain itself if people begin to question how government officials can win “peace prizes” on the same day they escalate wars? system October 12, 2009 | 7:19 am LA TImes Community activists today are calling for the appointment of a federal monitor to oversee the L.A. County Department of Children and Family Services after reports in The Times about the deaths of children in that system. The Times series has examined flaws in the safety net for children being monitored by the county. From January 2008 to early August 2009, at least 268 children who had passed through the child welfare system died, according to internal county records obtained by The Times.The records showed that 213 deaths were the result of unnatural or undetermined causes; 76 were homicides, 35 accidents and 16 suicides. Eighteen of the fatalities were deemed the direct result of abuse or neglect by a caregiver, subjecting them to public disclosure under a recent state law aimed at prevention. At a press conference today, representatives of several groups in South L.A. including the Los Angeles Civil Right Assn. and Los Angeles Urban Policy Roundtable will call on Health and Human Services Secretary Kathleen Sebelius to step in to make changes at the county agency and provide more funding. Mulls Liability of City Caseworkers for Removal Errors Mark Hamblett 10-08-2009 New York Law Journal Whether New York City social workers and agency officials should face liability for wrongfully or mistakenly removing children from allegedly abusive homes was at the center of oral arguments yesterday at the U.S. Court of Appeals for the Second Circuit. Judges Jose A. Cabranes and Roger Miner, and Southern District Judge Jed S. Rakoff, sitting by designation, heard argument in four cases concerning the proper degree of legal exposure for the city and employees of its Administration for Children's Services (ACS). Carolyn Kubitschek of Lansner Kubitschek Schaffer & Zuccardy in Manhattan, arguing for parents, foster parents and children who have been wrongfully removed from their homes, called the city agency "out of control." She contended that agency officials should be liable under federal civil rights law for relying on a doctor criticized for over-reporting child abuse, and that caseworkers should be held liable for prematurely removing a child or failing to act quickly in returning them once the parent or foster parent has been cleared of responsibility for the child's injury. But in arguing for immunity, Deborah Brenner of the New York City Law Department told the court that caseworkers should not be held liable for decisions they make under pressure. "Caseworkers walk a very fine line every day," she said. "They have to balance the right of the parent to family integrity" versus the safety of the children. Teen running from CPS worker struck by car By T.J. Aulds The Daily News Published October 8, 2009 TEXAS CITY — A 16-year-old girl who police said was trying to run away from a Child Protective Services worker was struck by a car on the Interstate 45 feeder road in Texas City on Wednesday night. The teen was taken by helicopter to the University of Texas Medical Branch’s John Sealy Hospital. Sgt. Joe Stanton said the teen was being driven to an unknown location when she told the protective worker she was feeling sick and needed to throw up. The CPS employee pulled the car over and let the girl get out to vomit, but a few seconds later the teen took off across a median and into a field near Holland Road, police said. The protective services employee called 911 asking for police assistance in finding the runaway. Before police could get to the scene, the teen reportedly came running back toward the freeway but was struck by a car on the northbound feeder road. The girl was taken to John Sealy and was reported to be in critical condition, Stanton said. Police had not confirmed where the girl was from or where she was being taken by the protective services staffer. The feeder road at Holland Road was shut down most the night as investigators mapped out the accident scene. CPS is the acronym for Children's PROTECTIVE "Services". We think the name is Orwellian "New Speak".

District Attorney spokesman John Hall says Sean Lamont Birdsong, 37, will face one count each of false imprisonment, sexual assault with intent to rape, lewd acts on a minor and child endangerment. Birdsong was arrested Sept. 22 and released after posting $50,000 bail, according to jail records. The county placed Birdsong on administrative leave on Sept. 24, pending the outcome of his case. "This agency is entrusted to help and protect children and we have no room here for anyone who violates that trust,"* said Susan Loew, the county's director of public social services. "If the allegations are true, this person should suffer the full penalty the law allows." Because he is messing up the scam? According to Loew, there has been no indication that Birdsong had acted inappropriately with any other children whose cases he handled. Birdsong was hired Aug. 31, 2006, after passing a background check required by the county as a condition of employment, she said. "There was nothing to indicate he might be a risk to children," Loew said. Riverside police began investigating Birdsong after a 15-year-old boy alleged the man had touched him inappropriately and tried to get him drunk, according to Hall. Birdsong had been assigned to the teen's case and was involved in placing him in a Rubidoux foster home, Hall said. "Birdsong instructed the boy to sneak out of the foster home and meet him down the street, which he did," Hall said. "Birdsong drove to a liquor store, where he purchased a bottle of Bacardi 151, then headed to his (Riverside) apartment." Once inside, Birdsong allegedly pressed the victim to drink the alcohol, and when the boy resisted, Birdsong told him he was armed and "he had better drink with him," Hall said. The boy reportedly told Birdsong that "he was scared and ... needed to go outside for a cigarette," Hall said. When he stepped outside the apartment, the boy approached another resident of the complex, asking her for help, Hall said. Riverside police officers arrived a short time later and, after questioning the boy and Birdsong, placed the latter under arrest. *Of course they have LOTS of room. Court reverses child abuse conviction of North Plainfield man By MICHAEL DEAK • STAFF WRITER • October 7, 2009 My Central New Jersey.com SOMERVILLE, New Jersey — The conviction of a North Plainfield man on sexual assault and endangering the welfare of a child charges has been reversed by a state Appellate Court and returned for a trial in Superior Court. In a ruling issued Monday, the appeals panel ruled the defendant, identified only as A.J. because the alleged victims were his stepdaughters, was entitled to a new trial because his attorney "performed deficiently, and that her inadequate performance, with reasonable probability, materially contributed to (A.J.'s) conviction." A.J. was sentenced to 26 years in prison after he was found guilty of engaging in criminal sexual conduct with his two stepdaughters from June 1996 through August 1997 when they were 13 and 16. The appeal centered on the failure of A.J.'s attorney to fully cross-examine C.J., A.J.'s wife and the mother of the girls, on alleged recantations by the girl about A.J.'s actions. C.J. had written a letter to the Prosecutor's Office asking the charges be dropped because "the girls have been lying about things that happened," court papers say. lawmakers want action on felonious caregivers The Associated Press October 5, 2009 FORT LAUDERDALE, Fla. -- Florida legislators have pledged to overhaul state law to require background checks for caregivers after a newspaper investigation identified flaws in the screening system that allowed felons to get jobs in day cares and nursing homes. The South Florida Sun Sentinel investigation found that thousands of people obtained exemptions that granted them permission to work as caregivers for children, the elderly and the disabled despite criminal records that included rape, child abuse and murder. The proposed new law would require uniform nationwide background checks for all caregivers before they can begin work. It would also require caregivers be rescreened every three years, instead of every five years as under the current law. "You have people committing terrible crimes working with vulnerable populations. That just doesn't seem appropriate to me," said state Rep. OFFERS $15 MILLION IN GRANTS SPOKANE, Wash. - The U.S. Department of Housing and Urban Development announced today that it is making $14.6 million in grants available to help local housing authorities across the country reunite thousands of children with their parents. The children are either in foster care or there is a threat of being placed in the foster care system. Local housing authorities must apply for the money by December 3, 2009. Additionally, 11 public housing authorities will receive $5.4 million immediately. To read the full text of the funding notice announced today, visit HUD's website. HUD Deputy Secretary Ron Sims announced the available funding at Housing Washington 2009, the 16th Annual Affordable Housing Conference in Spokane. "It's fitting that I announce these available grants to unite families here in Spokane, since I feel like I'm among family," said Sims, himself a Spokane native. "Earlier this week, President Obama proclaimed Family Day on September 28th (just one day? We sure didn't see that one) to emphasize the positive impact a loving, caring family has on children . Building strong, engaging families must first begin with a stable home. This funding will provide families the opportunity to safe, decent affordable housing for them and their children." This funding, that will support approximately 1,940 vouchers, will be available to public housing authorities through HUD's Family Unification Program (FUP), which provides rental assistance to families whose lack of adequate housing is a primary cause of parents being separated or near-separated from their children. In addition this funding is used to help provide stable housing for young adults (ages 18-21) who have aged-out of the foster care system. These vouchers, like HUD's Housing Choice Vouchers, allow a family to rent housing from a private landlord and generally pay 30 percent of the family's monthly adjusted gross income towards rent and utilities. The total 2009 funding is $20 million and, in addition to the $14.6 million in grants for housing authorities to apply for, 11 housing agencies will receive $5.4 million immediately. These agencies submitted qualified applications for 2008 funding, but were not awarded grants because all available funding was expended. Specific instructions in the 2008 funding notice guaranteed that approvable applications would receive money if funding was made available in 2009. According to statistics from the National Center for Housing and Child Welfare (NCHCW), an affordable housing/child welfare advocacy group, keeping children in foster care is an expensive alternative to affordable housing. On average, it costs more than $48,000 annually per family when children enter foster care. By contrast, housing and services to keep a family together costs approximately $15,000 annually. Supportive services for FUP families and youth are provided by agencies funded through the U.S. Department of Health and Human Services. A $20 million investment in FUP vouchers saves more than $134 million in foster care costs. Housing authorities that are awarded vouchers work closely with local public welfare agencies to identify youth at risk of homelessness and families for whom the lack of adequate housing is a primary reason the family's children are in, or must be placed in, foster care. Tammy Renee Silas, 39, is in custody on federal kidnapping charges. She hasn't been charged with the stabbing. The mother and baby are expected to be reunited for good soon. Colo. counties hire strategist to fight proposed child-welfare takeover Five counties are paying $1,200 each for a political consultant (spin doctor) to help fight a proposal that would allow the state to take over county responsibilities of child welfare and social services. Since the recommendations from a governor-appointed committee were given to Gov. Bill Ritter earlier this week, counties big and small have been in uproar. (caught in their murderous deeds) So far, Boulder, Jefferson, Arapahoe, Mesa and Douglas counties have committed $1,200 each toward hiring strategist Katy Atkinson to help them with communications and messaging for the next six weeks. Ritter has agreed to meet with them before making any decisions. Changing the county-state structure with human services would require legislation. Rob Johnson, a spokesman for the Tennessee Department of Children's Services, said the children were taken from their mother, Maria Gurrolla, "purely for safety reasons," though he would not detail why the state deemed they were in danger. "Our focus is on the children, and under the current situation right now, we think the safest thing to do is take the children into state custody," he said. Oh the pompous self-righteousness! Gurrolla, 30, was stabbed in her home Tuesday, just four days after giving birth to Yair Anthony Carillo, who was snatched by the attacker. Arrested On Drug Charges FLORIDA- Dr. Paul John Hartmann, a psychiatrist practicing in South Lakeland, was arrested in Tampa on Friday on seven charges of possession of a controlled substance, two charges of possession of a drug without a prescription and a charge of driving under the influence. Hartmann, 60, a board-certified psychiatrist with subspecialty certification in child and adolescent psychiatry, has a Tampa address on his Hillsborough County arrest record. But he is listed with the state Department of Health, and in the phone book, as practicing at 6700 S. Florida Ave. in Lakeland. His DOH record shows a clear license without a record of discipline.. Service Agency Workers Charged in Deadly Fraud Scheme PHILADELPHIA—United States Attorney Laurie Magid today announced the filing of a 21-count indictment charging eight employees of a social service agency with defrauding the City of Philadelphia and the federal government by falsely claiming to provide social services to needy families and then billing the City for the services. A ninth employee is charged with a single count of lying to a federal grand jury. The indictment alleges that the fraud scheme was carried out by employees of MultiEthnic Behavioral Health, Inc. (“MEBH”) and contributed to the death of a 14-year-old girl for whom the City’s Department of Human Services had hired MEBH to provide services. Joining in today’s announcement were Health and Human Services Special Agent-in-Charge Pat Doyle, FBI Special Agent-in-Charge Janice Fedarcyk, and Philadelphia District Attorney Lynne Abraham. The indictment alleges 12 counts of wire fraud, six counts of health care fraud, one count of conspiracy to obstruct a federal investigation, one count of providing a false statement to federal agents, and one count of perjury before a federal grand jury. Charged in the indictment are MEBH co-founders Mickal Kamuvaka, Solomon Manamela, Earle McNeill, and Manuelita Buenaflor; and MEBH workers Julius Juma Murray, Miriam Coulibaly, Christiana Nimpson, and Sotheary Chan. MEBH worker Patricia Burch is charged with one count of perjury. Sutter County Judge H. Ted Hansen on Friday granted defense attorney Timothy J. Evan's motion to reduce Sarah Jane Powell's felony conviction to a misdemeanor and sentenced her to 36 months probation. Prosecutor Cameron King had requested a 30-day jail sentence. Hansen cited Powell's lack of a criminal record, her quick confession and what he called her apparent desire to help the child, whose surgery had been delayed for months. "She pretty much fessed up pretty darn early," Hansen said. In his 16 years on the bench, Hansen said, he had never seen a case with so many mitigating factors in favor of a light sentence. The 10-year-old can list all the things she likes to do: read stories, write, talk, go to Six Flags and of course Sea World! But you really capture her spirit when she describes her 6-year-old sister Mary. Kayla says, "She's nice, pretty and plays with me." The little sister lights up, glowing in the compliments. For three years, Kayla and Mary have lived in foster care with many other children. According to Marleigh Meisner, (famous spin doctor in the FLDS fiasco last year) spokesperson for the Texas Department of Family and Protective Services, the agency is committed to keeping them together. Woman Gets 30 Months Prison For False Allegations That Launched DCFS Probe JOLIET, Illionis--(ENEWSPF)--September 19, 2009. Will County State's Attorney James Glasgow announced that a Naperville woman who wrote a series of anonymous letters that threatened and frightened Naperville School District 203 officials has been sentenced to 30 months in prison. Rita Mueller, 50, was found guilty in February of disorderly conduct. In 2005, Mueller sent an anonymous letter to the principal of B.J. Ward Elementary School in Bolingbrook falsely alleging that a student at the school was being sexually abused by her father. The student was the daughter of a Naperville School District employee. The one-count bill of indictment, handed up in August 2007, alleged that Mueller knew the principal was mandated by law to report the accusations to the Illinois Department of Children and Family Services, which launched an investigation that eventually cleared the father of the false allegations. Associate Judge Edward Burmila sentenced Mueller Friday morning and ordered her taken into custody immediately by Will County Sheriffs Police. Throughout 2005 and 2006, Mueller embarked on a bizarre and abusive anonymous letter-writing campaign that targeted a variety of Naperville School District officials. She admitted to police that she sent a package containing feces to one school official and what appeared to be a used condom to another.
