| CQ TODAY MIDDAY UPDATE Dec. 22, 2009 – 1:19 p.m. Republicans Lodge Constitutional Challenge to Health Bill Senate Republicans, defeated at every turn thus far in their bid to prevent Senate passage of a health care bill before Christmas, are digging into their parliamentary tool chest. John Ensign , R-Nev., lodged a constitutional point of order against the legislation on Tuesday, claiming its mandate that individuals purchase health insurance or pay a penalty falls outside the scope of congressional powers enumerated in Article I, Section 8, of the Constitution. It also violates the Fifth Amendment’s ban on the taking of private property for public purposes “without just compensation,” Ensign asserted. While the Senate is unlikely to uphold his challenge, Ensign raised points that could very well resurface in litigation if the legislation becomes law. The Senate will vote on Ensign’s challenge Wednesday. Ensign argued that Congress does not have the power to require individuals to purchase a particular good, in this case health insurance. “Is it really constitutional for this body to tell all Americans that they must buy health insurance coverage?” Ensign asked. “And if so, what’s next? What personal liberty or property will Congress seek to take away from Americans next?” (oh I dunno- maybe their KIDS?) He added, “If one of my constituents in Nevada does not want to spend his or her hard-earned income on health insurance coverage and would prefer to spend it on something else such as rent or a car payment, this requirement could be a taking of private property under the Fifth Amendment.” FULL STORY |

Reid has slipped in a provision into the health care legislation prohibiting future Congresses from changing any regulations imposed on Americans by the Independent Medicare [note: originally referred to as "medical"] Advisory Boards, which are commonly called the “Death Panels.” It was Reid leading the Democrats who ignored 200 years of Senate precedents to rule that Senator Sanders could withdraw his amendment while it was being read. It was Reid leading the Democrats who has determined again and again over the past few days that hundreds of years of accumulated Senate parliamentary rulings have no bearing on the health care vote. (This procedure will work for any bill you wish to look at.) How your Senator voted on cloture December 21, 2009, in the middle of the night, can be found here and also accessible under "All Congressional Actions with Amendments" when H.R. 3590 is put in the search slot on the main page of thomas.loc.gov. The vote was all Democrats (60) voting "yes" and all Republicans (40) voting "no". You will note that this bill, voted on by the Senate, is not a Senate bill; it is a House bill. How can it be that a House bill was used to introduce language written by the Senate? A House bill was used, its language stricken and substituted by Senator Reid and his co-conspirators, because the Senate cannot, constitutionally, introduce a bill that appropriates money. As such, the Senate's way of circumventing this is to take a House bill, sent to the Senate after House passage, and strike the language and introduce language written by Senators. Is this constitutional? Let's put it this way, that was not what was intended when the Constitution was written. But then, the Constitution, in the words of John Adams, was written for a moral and religious people; being wholly inadequate for people who have no morals, no conscience and certainly no principles or standards; who believe right and wrong are situational, pliant to whatever their agenda is. 5:13 P.M. ET Change Nobody Believes In A bill so reckless that it has to be rammed through on a partisan vote on Christmas eve. Wall Street Journal And tidings of comfort and joy from Harry Reid too. The Senate Majority Leader has decided that the last few days before Christmas are the opportune moment for a narrow majority of Democrats to stuff ObamaCare through the Senate to meet an arbitrary White House deadline. Barring some extraordinary reversal, it now seems as if they have the 60 votes they need to jump off this cliff, with one-seventh of the economy in tow. Mr. Obama promised a new era of transparent good government, yet on Saturday morning Mr. Reid threw out the 2,100-page bill that the world's greatest deliberative body spent just 17 days debating and replaced it with a new "manager's amendment" that was stapled together in covert partisan negotiations. Democrats are barely even bothering to pretend to care what's in it, not that any Senator had the chance to digest it in the 38 hours before the first cloture vote at 1 a.m. this morning. After procedural motions that allow for no amendments, the final vote could come at 9 p.m. on December 24. Even in World War I there was a Christmas truce. The rushed, secretive way that a bill this destructive and unpopular is being forced on the country shows that "reform" has devolved into the raw exercise of political power for the single purpose of permanently expanding the American entitlement state. An increasing roll of leaders in health care and business are looking on aghast at a bill that is so large and convoluted that no one can truly understand it, as Finance Chairman Max Baucus admitted on the floor last week. The Rev. Jesse Jackson said Wednesday night that any black lawmaker who votes against President Obama's sweeping health care overhaul isn't really black, the Hill newspaper reported.
The Rev. Jesse Jackson on Wednesday night injected race into the national debate on health care, saying any black lawmaker who votes against President Obama's sweeping overhaul isn't really black, the Hill newspaper reported.
"We even have blacks voting against the health care bill," Jackson reportedly said at a Congressional Black Caucus reception Wednesday night honoring the 25th anniversary of the civil rights leader's run for president.
"You can't vote against health care and call yourself a black man," the Hill reported him saying.
The remark was a clear shot at Rep. Artur Davis, D-Ala., the only member of the CBC to vote against the House version of the health care legislation.
Davis refused to return fire against Jackson.
"One of the reasons that I like and admire Rev. Jesse Jackson is that 21 years ago he inspired the idea that a black politician would not be judged simply as a black leader," Davis said in a written statement to the newspaper. "The best way to honor Rev. Jackson's legacy is to decline to engage in an argument with him that begins and ends with race."

Chinese officials generally are very careful about commenting on the dollar and Treasuries, given that so much of its US$2.3 trillion reserves are tied to their value, and markets always watch any such comments closely for signs of any shift in how it manages its assets. China's State Administration of Foreign Exchange reaffirmed this month that the dollar stands secure as the anchor of the currency reserves it manages, even as the country seeks to diversify its investments. In a discussion on the global role of the dollar, Zhu told an academic audience that it was inevitable that the dollar would continue to fall in value because Washington continued to issue more Treasuries to finance its deficit spending. He then addressed where demand for that debt would come from. "The United States cannot force foreign governments to increase their holdings of Treasuries," Zhu said, according to an audio recording of his remarks. "Double the holdings? It is definitely impossible." "The US current account deficit is falling as residents' savings increase, so its trade turnover is falling, which means the US is supplying fewer dollars to the rest of the world," he added. "The world does not have so much money to buy more US Treasuries." China continues to see its foreign exchange reserves grow, albeit at a slower pace than in past years, due to a large trade surplus and inflows of foreign investment. Care and Parental Rights Rumor has it the latest version of the Health Care Bill, H. Res. 3962, is scheduled to be voted on Thursday, November 5. While the narrow scope of ParentalRights.org’s mission means we have no official position on health care in general, we have great concerns about any proposed bill that would impact parental rights. On page 1176 of the current 1990-page proposal, one finds the beginning of Section 1904: “Grants to States for Quality Home Visitation Programs for Families with Young Children and Families Expecting Children.” Under the provisions of this section, federal funds would be made available “to provide voluntary home visitation for as many families with young children (under the age of school entry) and families expecting children as practicable, through the implementation or expansion of high quality home visitation programs…” (p. 1182, emphasis added). Such programs often lead to unnecessary and harmful government intrusion into the home. Further, what begins as voluntary often becomes mandatory, especially if it provides a conduit for federal funds to be poured into state projects. Finally, the language “for as many families…as practicable” creates a mandate (as the funds provide a motive) for states and their agencies to invade every family unit that they can. Of course, this particular section would not be a concern if the Constitution already included the proposed Parental Rights Amendment to protect the liberty of fit parents to direct the education and upbringing of their children. Once the amendment is adopted, the rights of parents will be protected even when state counselors have a good reason to visit the home (though the amendment will not harbor child abusers). The primary role of parents, rather than bureaucrats, in decision-making for children will be permanently secured. If you have an opinion to share with your congressman regarding H.
