Can you fight cps?

Several people have been asking questions along that line.

Sure you can.

Right now I am thinking of that poster of a great big eagle about to grab a defiant little mouse with both talon-filled feet.

If you don't want to go through a learning curve before standing up to them, the outcome is certain.

Perhaps about the same certainty as just doing everything the CPS agent tells you.

If CPS agents have a common trait, it is pompous insolence.  To put it bluntly, the worst crime on earth you can commit is "Contempt of Social Worker".  These pukes don't care about the truth, and they are looking for a reason to crucify you to begin with.  With a few furtive strokes of their poison pen, your life as you knew it- is over.

So the first piece of advice to the wise is- Treat that CPS agent with ultimate (and undue) respect.  Which is NOT the same thing as surrender and resignation.

These people are accomplished masters of the politically correct, authoritative, condescending Orwellian doublespeak.

You have to be authoritative too-

"I would love to answer your question, but I cannot do that without violating my Fifth Amendment Rights and my Miranda Rights"

"I would love to let you in my house to look around without a Search Warrant.  But I cannot do that without violating my Fourth Amendment Rights"

You are not being condescending to the CPS agent, because she is highly unlikely to know anything about Constitutional Rights beyond what she might have seen in movies or on TV.  You are having to be educational while you are standing up for your rights.

After that she will probably threaten you with all the terrible things she can do to you if you don't buckle under to her.  She can threaten all she wants but-

"The claim and exercise of a Constitutional right cannot be converted into a crime." Miller v. U.S. 230 F 2d 486, 489.

And basically, the CPS agent's threats amount to her Practicing Law Without a License.

If our CPS agent is sufficiently motivated, what will come next is she will claim this is an "emergency" (an exigent situation in their lingo).

You agree to nothing.

You do NOT sign ANYTHING without a GOOD lawyer's recommendation.

And then we are off to the Soap Opera. Again.

Time for you to go through a massive learning curve.  You are going to need it.

I am not a lawyer and I do not pretend to give legal advice. If you need legal advice, see AFRA's Lawyer Friends who certainly are not pretenders (http://familyrights.us/info/law) I merely relate the things I learned in the past that seemed to work in my own case or things that others have related to me that worked in their cases. I provide information for free and do not expect to receive any form of payment or reward on this side of heaven. Therefore, DO NOT rely on this information as legal advice. Real Legal advice would come from a real lawyer who hates CPS and prepares a VIGOROUS DEFENSE against a negative (proving nothing happened) instead of talking you into a plea bargain (http://familyrights.us/bin/The_Problem_with_Plea_Bargaining.htm)
